What Is Mediation? 

Mediation is an informal but professional, non-adversarial dispute process. Two parties in a situation are assisted by a neutral third party known as the Mediator to resolve the issue (s).

 

The Mediator works closely with both parties to find a creative and mutual solution through negotiation, encouragement, and guidance to reach a settlement.

What Is the Role of a Mediator? 

A Mediator does not offer advice regarding the issue or give legal advice regarding the issue or situation. The Mediator’s role is to guide the discussion and present the facts clearly so the two parties can find a middle ground.

 

The Mediator prepares a Mediation Statement Agreement (MSA) that both parties receive; filing the MSA is at each client’s discretion.

 

The Mediator is not acting on the lawyer's behalf or as an advocator for either party.

What Is the Role of the Client? 

The client is in control of the outcome. The clients must agree to actively participate in the discussion and all decisions regarding the solution. Clients must agree to confidentiality guidelines. Both parties must sign the MSA.

What is the significance of a MSA?

Mediation Settlement Agreement (MSA) is a legal and binding contract. Both parties must sign the contract before the document can be enforced or filed.
